Article 1 – Registration and acceptance
1.1 Registration as a Braadbaas Affiliate implies acceptance of the Affiliate program terms and conditions and the obligation to comply with them.
2.2 To be registered as an Affiliate, the Affiliate must:
2.3 Braadbaas will generally inform you within 8 days of receipt of the fully completed registration form, confirming acceptance of the Affiliate program terms and conditions, whether Braadbaas accepts you as an Affiliate.
Article 2 – Use
3.1 The Affiliate site may not in any way give the public the impression that it belongs to Braadbaas, or that it was developed by Braadbaas. It must also be unambiguously clear that Braadbaas has no control over and is not responsible for the Affiliate site. The Affiliate will leave no doubt that the Articles promoted via the Affiliate site are sold not by the Affiliate, but by Braadbaas.
3.2 The prices of the Articles on the website may change regularly. The Affiliate will ensure that the prices/availability of the Articles (possibly) stated on the Affiliate site are updated as quickly as possible so that they are in accordance with the prices/delivery times stated on the webshop from time to time.
Article 3 – Commission
4.1 The registration by Braadbaas of impressions, clicks and sales, which are valid via the portal, are binding for Braadbaas and the Affiliate.
4.2 Braadbaas measures all Article sales to the Customer using a First Party Cookie. The First Party Cookie generally has a Cookie period of 14 days. However, Braadbaas reserves the right to change the Cookie period and to apply different Cookie periods for different Affiliates.
4.3 The Affiliate can claim commission for all Articles purchased by a Customer from Braadbaas directly after clicking on the Affiliate link or within the First Party Cookie period, provided that Braadbaas has actually received the relevant payment and the 30-day cooling-off period after receipt has expired without the return of the relevant products.
4.4 If the Customer returns the Articles and/or the payment is canceled for whatever reason, the Affiliate can no longer claim the relevant commission. If the payment has already been made, the Affiliate must repay the already received commission to Braadbaas.
4.5 The commission is calculated on the actual sales value received by Braadbaas including VAT (excluding any shipping costs).
Article 4 – Payment
5.1 The affiliate can transfer commission payments to their Paypal account via the portal. It is recommended to wait 30 days before payout to avoid refunds.
5.2 Braadbaas is at all times entitled to offset any amount it owes to the Affiliate with any amount that Braadbaas may claim from the Affiliate, for whatever reason.
Article 5 – Termination of Braadbaas Affiliate Program
6.1 Braadbaas is at all times entitled – without stating reasons – to terminate the Affiliate Program under these Affiliate program terms and conditions by email, with due observance of a notice period of two (2) weeks.
6.2 The Affiliate can at any time – without stating reasons – terminate their Affiliate Program by sending an email to hallo@braadbaas.nl.
Article 6 – Consequences of termination of Braadbaas Affiliate Program
7.1 If the Affiliate Program is terminated for any reason whatsoever:
7.2 Only if the Affiliate Program under these Affiliate program terms and conditions has been terminated will the Affiliate still be able to claim payment of commission for sales of the Articles for which the funds have been received by Braadbaas before the termination date.
7.3 Braadbaas and the Affiliate cannot claim any compensation from the other party in connection with the termination of the Affiliate Program under these Affiliate program terms and conditions and hereby waive any right to any (damage) compensation.
Article 7 – Liability
8.1 The Affiliate is fully responsible and liable for their use, development and maintenance, functioning and content of the Affiliate site. The Affiliate warrants that all obligations under tax legislation are met and indemnifies Braadbaas against all claims and/or costs/fines/additional assessments in this regard.
Article 8 – Miscellaneous
9.1 The Affiliate will never represent themselves as an agent or representative of Braadbaas and will in particular not make any promises or enter into any obligations for or on behalf of Braadbaas. The Affiliate fully indemnifies Braadbaas for all damages and/or costs of any kind arising from the non-compliance with this article.
